Ecozyra — Terms & Conditions

Welcome to Ecozyra (the “Platform”, “we”, “us” or “Ecozyra”). These Terms & Conditions (“Terms”) govern your access to and use of https://ecozyra.com/ and any related mobile applications, services, and features provided by Ecozyra (collectively, the “Services”). By accessing, registering for, or using the Services you agree to be bound by these Terms. If you are accepting these Terms on behalf of an organisation or business, you represent that you have the authority to bind that entity.

Please read these Terms carefully. If you do not agree to these Terms, please do not use the Services.


1. Definitions

  • User: any person or entity using the Platform, including Travellers and Providers.

  • Traveller: a User who searches, requests information or sends booking leads to Providers through the Platform.

  • Provider: an owner/operator of a listing on Ecozyra such as a homestay host, local tour guide, trek leader, taxi operator, or agro-tourism host.

  • Listing: content, information and media uploaded by a Provider about a service offered (e.g., homestay listing, trek listing).

  • Lead/Booking Request: information submitted by a Traveller to express interest in a Provider’s service.

  • Fees: any commission, listing fee, transaction fee or other amount Ecozyra charges in connection with the Services, as disclosed on the Platform.


2. Nature of the Platform — Marketplace Role

Ecozyra operates as an online listing and lead-generation platform that connects Travellers with independent local Providers who offer eco-friendly and sustainable tourism services. Ecozyra facilitates discovery, profile hosting, lead delivery and (where indicated) payment facilitation. Ecozyra is not the seller, provider or operator of travel products or services listed by Providers, unless explicitly agreed in writing. Contracts for tours, stays, treks, transport and other travel services are directly between Travellers and Providers.

You acknowledge and agree that Ecozyra has no responsibility for the acts or omissions of Providers, their employees, agents or subcontractors, or for the performance, safety or quality of services offered by Providers. We may, however, offer dispute-resolution assistance and mediation at our discretion.


3. Eligibility & Account Registration

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By registering you confirm that you are legally able to enter into binding contracts.

  • Registration requires a valid email address, phone number and password. You agree to provide accurate, current and complete information and to maintain and promptly update your account information.

  • Providers must complete KYC/verification steps we require for onboarding (ID, PAN for Indian Providers for payout/KYC, police verification and any necessary professional certificates). Ecozyra may refuse, suspend or terminate accounts that fail verification.

  • You are responsible for keeping your password and account secure and for all activity that occurs under your account.


4. Provider Listings & Obligations

Providers may create Listings describing their services. By creating a Listing you represent and warrant that:

  • All information, images and claims in the Listing are true, accurate, complete and not misleading.

  • You hold all rights and permissions required to post the content (including rights to the images and videos).

  • You will maintain up-to-date information about availability, pricing and terms.

  • You comply with all local laws, permits, registrations and tax requirements (including GST obligations in India where applicable). Providers are solely responsible for booking permits (e.g., protected-area permits), local licenses, and any regulatory approvals required to operate.

  • You will maintain appropriate safety standards and insurance for activities you offer. Providers are encouraged to carry public liability and rescue insurance and to inform Travellers of recommended travel and evacuation insurance.

  • You will follow Ecozyra’s Sustainability Code (leave-no-trace, minimising single-use plastics, promoting local employment/homestays, etc.) where applicable and truthfully represent any sustainability claims. Ecozyra may audit sustainability claims and withdraw eco-badges for false claims.

Ecozyra reserves the right to remove or suspend Listings at our discretion (for example, if a Listing violates these Terms, local law, safety standards, or our policies).


5. Traveller Obligations

  • Travellers must provide accurate details in lead/booking requests and must inform Providers of any relevant medical conditions, fitness limitations or special requirements prior to booking.

  • Travellers are responsible for obtaining appropriate travel, health and evacuation insurance, necessary permits and vaccinations required for their travel plans.

  • Travellers must follow Provider rules, local community customs and Ecozyra’s guidelines for responsible travel. Travellers must not engage in illegal activities or behaviour that endangers people, wildlife or the environment.

  • Any agreement regarding price, inclusions/exclusions, cancellation policy or other booking terms is directly between the Traveller and the Provider; Travellers should confirm such terms before confirming or paying.


6. Leads, Bookings & Payments

  • Ecozyra transmits booking requests and leads; how payments are handled depends on the Provider. Some Providers accept payment directly from the Traveller; others may use payment gateways integrated with Ecozyra. Where Ecozyra facilitates payments, payment terms and third-party payment provider terms will apply. Ecozyra is not responsible for payment disputes between Travellers and Providers except as provided in our dispute resolution process.

  • Fees and commissions collected by Ecozyra will be disclosed to Providers at the time of onboarding or in the Provider dashboard. Providers agree that Ecozyra may deduct applicable Fees from payouts where agreed.

  • Taxes: Providers are responsible for local taxes (e.g., GST) and Ecozyra may collect tax-related information such as GSTIN for compliance. Travellers are responsible for any taxes that apply to their bookings under applicable law.

  • Cancellation, refunds and changes: Unless Ecozyra explicitly controls a payment or booking product, cancellation and refund policies published by the Provider on their Listing govern the transaction. Ecozyra recommends that both Travellers and Providers document terms clearly before any payment is made.


7. Verification, Reviews & Ratings

  • Ecozyra may perform identity and document verification of Providers and may display verification badges. Verification does not constitute a warranty or guarantee of a Provider’s reliability or fitness.

  • Travellers may post reviews and ratings about Providers. Reviews must be accurate, honest and not defamatory. Ecozyra reserves the right to moderate, remove or refuse reviews that violate policies (spam, hate speech, explicit content, false statements).

  • Providers may respond to reviews. Abuse of the review system (fabricated reviews, review manipulation) may result in account suspension.


8. Prohibited Conduct

When using the Services you must not:

  • Post or transmit illegal, fraudulent, misleading or infringing content.

  • Misrepresent identity, location, qualifications or certification.

  • Engage in harassment, hate speech, threats, or other abusive conduct.

  • Use automated means to scrape or harvest data from the Platform without our prior written consent.

  • Circumvent Ecozyra’s fees or payment flows by transacting off-platform in ways that violate Ecozyra’s policies. Repeated off-platform transactions may lead to suspension.


9. Intellectual Property

  • Ecozyra and its licensors own all rights, title and interest in the Platform and its contents (except for User content). You may not copy, modify, distribute or create derivative works of the Platform content without prior written consent.

  • By posting Listings, images, videos, text or other materials to Ecozyra, you grant Ecozyra a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish and display such content on the Platform and promotional channels for the purpose of operating the Services. You warrant you have the rights to grant this license.


10. Privacy & Data Protection

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use and share personal data. By using the Platform you consent to the collection and use of your information as described in the Privacy Policy. Providers must ensure they process Traveller personal data only as permitted by law and by our policies. For Indian users, Ecozyra processes personal data in line with applicable laws including the Digital Personal Data Protection Act, 2023.


11. Disclaimers & No Warranty

THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. Ecozyra MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. ECOZYRA DOES NOT WARRANT THE QUALITY, SAFETY OR LEGALITY OF ANY LISTINGS OR SERVICES OFFERED BY PROVIDERS.

We strongly recommend that Travellers obtain appropriate travel insurance and verify Provider credentials and safety arrangements before booking.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ECOZYRA, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM OR ANY TRANSACTION BETWEEN YOU AND A PROVIDER.

IN NO EVENT SHALL ECOZYRA’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE AMOUNTS PAID BY YOU TO ECOZYRA IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR INR 10,000 (TEN THOUSAND RUPEES), WHICHEVER IS HIGHER. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY; IN SUCH CASES LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.


13. Indemnity

You agree to indemnify, defend and hold harmless Ecozyra, its affiliates and their respective officers, directors, employees and agents from and against any and all liabilities, losses, damages, claims, costs and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your breach of these Terms; (b) your Listing or content; (c) your interactions with other Users; or (d) your negligence or willful misconduct.


14. Suspension & Termination

  • Ecozyra may suspend or terminate your account and access to the Services at any time for conduct that violates these Terms, for safety reasons, for suspected fraud or non-compliance, or for any lawful reason. In many cases Ecozyra will provide notice and an opportunity to cure, but immediate suspension may occur for urgent safety concerns.

  • On termination, rights and obligations that should survive (e.g., indemnity, limitation of liability, dispute resolution, intellectual property) will continue to apply.


15. Dispute Resolution & Governing Law

  • These Terms are governed by the laws of India. Except where mandatory consumer laws apply, you agree that non-criminal disputes will be resolved under the exclusive jurisdiction of the courts located in [Insert City, India] (please replace with your company’s preferred jurisdiction). If you prefer, Ecozyra may offer mediation or arbitration as an alternative dispute resolution mechanism; such options will be set out in a separate agreement or policy.

  • Nothing in this clause limits any mandatory statutory rights you may have as a consumer.


16. Changes to Terms

Ecozyra may modify these Terms from time to time. When we update the Terms we will post the updated version with a new “Last updated” date and, if the changes are material, provide prominent notice (for example, by email or an in-app notice). Continued use of the Services after changes constitutes acceptance of the updated Terms.


17. Notices

We may provide notices to you through the email address associated with your account, by posting notices on the Platform, or by other means as required by law. You consent to receive electronic communications from Ecozyra.


18. Miscellaneous

  • Severability: If any provision of these Terms is found unenforceable, the remainder will remain in full force.

  • Waiver: Any waiver of a provision must be in writing and signed by Ecozyra. Failure to enforce a right is not a waiver.

  • Assignment: You may not assign these Terms without Ecozyra’s prior written consent. Ecozyra may assign these Terms in connection with a merger, sale or transfer of assets.

  • Entire Agreement: These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Ecozyra regarding the Services.


19. Provider-specific & Sustainability Requirements (summary)

Providers must comply with all applicable laws, maintain accurate listings, carry necessary permits and safety equipment, and follow Ecozyra’s Sustainability Code where relevant. Ecozyra reserves the right to suspend eco-certifications and remove Providers who misrepresent sustainability practices or harm local communities or ecosystems.
